Sentencing Punishments for Larceny in New York

You will be charged with petit larceny if you are accused of stealing an item valued at $999 or less. As a class A misdemeanor, petit larceny can be punished withup to one year in imprisonment and up to $1,000 fine. The theft of an item that does not trigger petit larceny charges will trigger a felony charge of grand larceny instead.

Grand larceny classifications and punishments include:

  • Item valued between $1,000 and $2,999: Class E felony that can be punished with four years’ imprisonment and $5,000 fine.
  • Item valued between $3,000 and $49,999: Class D felony that can be punished with seven years’ imprisonment and $5,000 fine.
  • Item valued between $50,000 and $999,999: Class C felony that can be punished with 15 years’ imprisonment and $5,000 fine.
  • Item valued at $1 million or more: Class B felony that can be punished with 25 years’ imprisonment and $5,000 fine.

It is worth noting that high level larceny sentencing can include a fine equal to double the value of the stolen property, based on a judge’s discretion. For example, if you were convicted for stealing a car valued at $20,000, the fine could be up to $40,000.
