Penalties for grand larceny convictions in New York include:

  • Fourth-degree grand larceny: The value of the stolen property is between $1,000 and $3,000. This felony offense is punishable by up to 4 years in prison, as well as a fine of up to $5,000 or double the offender’s gain from the crime (whichever is greater).
  • Third-degree grand larceny: Stolen property is worth between $3,000 and $5,000. This felony crime is punishable by up to 7 years in prison, as well as a fine of up to $5,000, or double the offender’s gain from the crime (whichever is greater).
  • Second-degree grand larceny: Property stolen is worth between $50,000 to $1 million. The maximum penalty is up to 15 years imprisonment, and/or a fine double the offender’s gain from the crime.
  • First-degree grand larceny: This is the most serious of embezzlement charges, and involves stolen property exceeding $1 million. Conviction results in a maximum penalty of 25 years in prison or double the offender’s gain from the crime.
