Brooklyn Grand Larceny Defense Attorneys

Grand larceny is a serious theft crime of property belonging to someone else without the intention to return it. In some cases, the question of intent becomes a central issue and can be the basis of the defense. For example, it may be more difficult to prove a charge of shoplifting if the accused has not yet left the store with any merchandise. By contrast, if a person enters a car, hotwires it, and drives away, the intent of the charged person is much clearer.

Understanding New York Grand Larceny Laws

Under New York law, there are four degrees of larceny. Another, smaller theft is called petit larceny, involving the theft of property valued at less than $1,000, per New York Penal Law § 155.25.

Penalties for grand larceny convictions in New York include:

  • Fourth-degree grand larceny: The value of the stolen property is between $1,000 and $3,000. This felony offense is punishable by up to 4 years in prison, as well as a fine of up to $5,000 or double the offender’s gain from the crime (whichever is greater).
  • Third-degree grand larceny: Stolen property is worth between $3,000 and $5,000. This felony crime is punishable by up to 7 years in prison, as well as a fine of up to $5,000, or double the offender’s gain from the crime (whichever is greater).
  • Second-degree grand larceny: Property stolen is worth between $50,000 to $1 million. The maximum penalty is up to 15 years imprisonment, and/or a fine double the offender’s gain from the crime.
  • First-degree grand larceny: This is the most serious of embezzlement charges, and involves stolen property exceeding $1 million. Conviction results in a maximum penalty of 25 years in prison or double the offender’s gain from the crime.
